Official Rules and Terms & Conditions

Quick version (the full Terms below control): Subscribe on YouTube, follow on Twitch, then type !enter in Twitch chat — once; entering means you agree to these terms. The first 500 valid entries each get one Pokémon TCG booster pack. After that, every 100 additional entries, we randomly draw 10 entrants who haven't received a pack yet — until 1,000 packs total or December 31, 2026, whichever comes first. Every pack is opened live on stream. You then tell us — in chat, or within 48 hours of our Discord message (Discord is the only way we'll contact you, so join the server and make sure we can match you to your Twitch name) — whether to mail the cards to you (free, lower-48 U.S. only, using a $0.00 coupon code at our store within 30 days), pass them to the next person in line, donate them to a local card shop's free pile, or destroy them. No purchase necessary. One pack per person and per address. Must be 13+; if you're under 18, a parent or guardian has to agree to these terms and be the one who receives any mailed cards. Card contents, condition, and value are not guaranteed. We don't keep your address or email after your cards ship.

1. Sponsor

This promotion (the "Promotion") is sponsored and administered by The Company, Inc., d/b/a "The Company," a Colorado corporation, 5390 N. Academy Blvd, Suite 250, Colorado Springs, CO 80918 ("Sponsor," "we," "us," "our").

This is a promotion by The Company, Inc. Twitch does not sponsor or endorse this promotion and is not responsible for it. The Promotion is in no way sponsored, endorsed, or administered by, or associated with, Twitch Interactive, Inc., YouTube, Google LLC, Discord Inc., The Pokémon Company International, Nintendo, Creatures Inc., or GAME FREAK inc. (see Section 17).

2. Agreement to These Terms

By typing !enter in Sponsor's Twitch chat, or otherwise participating in the Promotion, you confirm that you have read, understood, and agree to be bound by these Official Rules and Terms & Conditions ("Terms") and by Sponsor's decisions, which are final and binding on all matters relating to the Promotion. If you do not agree, do not enter. The bot's !enter confirmation message will remind you of this and link to these Terms, which are also available at https://store.thecompany.inc/pages/giveaway-terms and by typing !terms in Twitch chat.

3. Eligibility

To be eligible, at the time of entry you must:

(a) be a legal resident of one of the 48 contiguous United States or the District of Columbia (residents of Alaska, Hawaii, U.S. territories, and all locations outside the United States are not eligible, because prizes cannot be shipped there); (b) be at least thirteen (13) years old. If you are 13 to 17, you must have your parent's or legal guardian's permission to enter, and by entering you represent that a parent or legal guardian has reviewed these Terms and consents to your participation, including the publicity terms in Section 14. A parent or legal guardian must complete any store redemption under Section 10 in their own name, confirm their agreement to these Terms at checkout, and be the named recipient at the shipping address. In unusual cases Sponsor may ask for written parental consent before shipping and may hold the prize until it is received. Entrants under 13 are not eligible under any circumstances; Sponsor does not knowingly collect personal information from children under 13, and if Sponsor learns an entrant is under 13 it will void the entry and delete the related information; (c) have a Twitch account and a YouTube account, each in good standing, created and used in compliance with the Twitch Terms of Service and Community Guidelines and the YouTube Terms of Service and Community Guidelines (https://www.youtube.com/howyoutubeworks/policies/community-guidelines/); and (d) not be currently banned, suspended, or timed out from Sponsor's Twitch channel, Discord server, or YouTube channel.

Sponsor does not expect to ask anyone for proof of eligibility, and it is very unlikely you will be asked; Sponsor only reserves the right to do so if it has a specific reason to doubt an entry. Entries that do not comply with the Twitch or YouTube Community Guidelines or Terms of Service will be disqualified.

4. Promotion Period and Phases

The Promotion begins at 8:00 p.m. Mountain Time on Tuesday, September 8, 2026 and ends at 11:59:59 p.m. Mountain Time on December 31, 2026, or earlier if 1,000 Packs have been opened (the "Promotion Period"). Entries may be submitted at any time during the Promotion Period; commands sent before it begins will not be counted. The Promotion has two phases:

  • Phase 1 — First 500. The first 500 valid entries each receive a Pack (Section 6).
  • Phase 2 — Milestone Drawings. Beginning with the 501st valid entry, each additional 100 valid entries triggers a random drawing of ten (10) entrants who have not yet received a Pack (Section 7), until a total of 1,000 Packs have been opened or the Promotion Period ends, whichever comes first.

Sponsor's chat-bot log is the official timekeeper and entry counter. Milestones reached before the end of the Promotion Period will be honored even if the drawing or pack opening takes place after December 31, 2026. Sponsor opens Packs during its live broadcasts as time allows and does not promise that any drawing or Pack opening will happen by a particular date, but will make reasonable efforts to complete all drawings and openings by March 31, 2027. A partial milestone (fewer than 100 additional valid entries) does not trigger a drawing. Sponsor may extend, shorten, pause, or reopen the Promotion Period under Section 18.

5. How to Enter

No purchase necessary. Complete all three steps during the Promotion Period:

  1. Subscribe to Sponsor's YouTube channel at https://www.youtube.com/@The-Company-Inc (free).
  2. Follow Sponsor's Twitch channel at https://www.twitch.tv/TheCompanyInc (free).
  3. In Sponsor's Twitch chat, type !enter. Entering is your agreement to these Terms; the bot's confirmation message will say so and link to them.

An entry is valid only if the !enter command is sent from a Twitch account that is following Sponsor's Twitch channel and belongs to a person who has subscribed to Sponsor's YouTube channel, and only if the entrant otherwise meets these Terms. Entries are recorded in the order Sponsor's chat bot logs each valid !enter.

Enter once. One entry per person for the entire Promotion. Your single entry places you in the Phase 1 line and, if you are not among the first 500, keeps you on the Waitlist and in every Phase 2 drawing until you become a Pack Recipient (Section 7.4). Additional or duplicate entries are void and may result in disqualification (Section 8).

Verification. Sponsor does not plan to ask anyone to prove anything, and it is very unlikely you will be asked. Sponsor's bot checks Twitch follow status automatically. Sponsor reserves the right, if something about an entry looks wrong (for example, suspected duplicate or automated accounts), to ask you to show your YouTube subscription or confirm that you control your Twitch account; if you do not respond to such a request within 48 hours, your entry may be voided.

Free means free. Paid Twitch subscriptions, Bits, Cheers, channel points, donations, tips, and store purchases are not required and do not affect whether you enter, where you rank in Phase 1, or your chances in any Phase 2 drawing. Following and subscribing are free actions.

Account requirements. Sponsor may require a verified email address or phone number to chat, and may enable followers-only chat, during the Promotion Period. Entries can only be made by accounts able to chat under whatever settings are in effect at the time.

6. Phase 1 — First 500

The first 500 valid entries, in the order recorded by Sponsor's chat bot, are "Qualified Entrants." Each Qualified Entrant receives one Pack under Section 9. Valid entries recorded after the 500th are placed on a "Waitlist" in the order received. Waitlist entrants may receive a Pack through the Pass-Along option (Section 9.4(b)) or through a Phase 2 drawing. If fewer than 500 valid entries are received by the end of the Promotion Period, only those entrants receive Phase 1 Packs and Phase 2 does not occur.

7. Phase 2 — Milestone Drawings

7.1 Milestones. Each time the total number of valid entries recorded by Sponsor's chat bot reaches 600, 700, 800, and so on in increments of 100 (each a "Milestone"), Sponsor will conduct one random drawing for that Milestone.

7.2 Eligible pool. The pool for a Milestone drawing consists of every valid entry recorded as of the moment that Milestone was reached, excluding Pack Recipients (Section 7.4) and anyone disqualified under Section 8. Each eligible entrant has exactly one entry in the pool, regardless of watch time, subscription status, purchases, or any other factor.

7.3 Selection and odds. Sponsor will select ten (10) entrants at random from the eligible pool, using its chat bot's random-selection feature or another random-number method, during one of Sponsor's live broadcasts after the Milestone is reached. Odds of being selected in a given drawing depend on the number of eligible entries in that drawing's pool. If a selected entrant is found ineligible or is disqualified before their Pack is opened, Sponsor may draw a replacement from the same pool. Each selected entrant (a "Drawing Winner") receives one Pack under Section 9, opened on stream, and makes a Decision under Section 9.4 like any other recipient. Once a Pack has been opened for a Drawing Winner, the forfeiture rules in Section 12 apply and no replacement is drawn for that Pack.

7.4 Pack Recipients. A "Pack Recipient" is anyone for whom a Pack has been opened — a Qualified Entrant, a Pass-Along recipient, or a Drawing Winner — whether or not that person claimed the cards. Pack Recipients are removed from the Waitlist and are not eligible for any later drawing.

7.5 Cap. No more than 1,000 Packs will be opened in the Promotion: up to 500 in Phase 1 and up to 500 in Phase 2. Cards passed along under Section 9.4(b) are the same cards changing hands and do not count as an additional Pack. Phase 2 ends when the 1,000th Pack is opened or the Promotion Period ends, whichever comes first.

8. Limits and Anti-Abuse Rules

  • One pack per person, per household. Limit one (1) Pack per person, per Twitch account, per YouTube account, per Discord account, and per mailing address/household for the entire Promotion, whether received through Phase 1, the Pass-Along option, or a Phase 2 drawing. If more than one entry is traced to the same person or household, only the earliest valid entry counts.
  • One account. Entering from multiple Twitch accounts, or from accounts you do not personally control, is prohibited. All such entries are void.
  • No automation. Entries generated by bots, scripts, macros, alt-account farms, or any automated or programmatic means are void.
  • No selling or transferring. Entries, positions in line, drawing eligibility, packs, cards, and coupon codes may not be sold, traded, or transferred (except through the Pass-Along option).
  • Disqualification. Sponsor may, in its sole discretion, disqualify any person it reasonably believes has violated these Terms, used a bot or alternate account, provided false information (including about age), tampered with the entry or drawing process, harassed other participants or Sponsor's team, or acted in a disruptive or unsportsmanlike manner, and may refuse or cancel any shipment to an address that has already received a Promotion shipment. Sponsor's determinations are final. Sponsor reserves all legal remedies against anyone who attempts to undermine the Promotion.

9. The Prize and What You Can Do With It

9.1 The Prize. Each Qualified Entrant and Drawing Winner receives the contents of one (1) sealed Pokémon Trading Card Game booster pack (a "Pack") from a set chosen by Sponsor in its sole discretion. Approximate retail value ("ARV") of each Pack: $3.00. Total ARV of all prizes: up to $3,000. Up to 1,000 Packs will be awarded in total. Sponsor may substitute a Pack of equal or greater value if a chosen product becomes unavailable.

9.2 Packs are opened on stream. Sponsor will open each Pack live on its Twitch channel and/or YouTube channel during its regular broadcasts, in the order recipients are determined and as many per stream as time allows. Sponsor does not promise that any Pack will be opened on a particular stream or by a particular date (see Section 4). When your Pack is opened, Sponsor will announce your Twitch username, show the cards, and may state an estimated value. You do not need to be present when your Pack is opened. You will not receive a sealed Pack; the prize is the cards inside once opened.

9.3 No guarantees about cards or value. Sponsor buys Packs from ordinary retail sources and does not select, inspect, or alter their contents. The cards are provided "AS IS." Sponsor makes no representation or warranty of any kind, express or implied, about the contents, rarity, authenticity, print quality, centering, condition, collectibility, or value of any card. Any value Sponsor states on stream is an informal estimate for entertainment purposes only, may be based on third-party price aggregators at that moment, and is not an appraisal, guarantee, or offer. Sponsor will handle cards with reasonable care, but cards may show handling, edge, or surface wear from being opened and shown on camera, and Sponsor does not sleeve, grade, or authenticate cards. No cash or other substitution is available.

9.4 Your Decision. After your Pack is opened, you choose one of the following (your "Decision"):

(a) Mail them to me. Sponsor ships the cards to you at no cost under Section 10. (b) Pass them on. The cards go to the next eligible person on the Waitlist who is not a Pack Recipient (or, if there is no eligible Waitlist entrant, back to the Prize Pool). That person then makes their own Decision under this Section. You cannot direct the cards to a specific person. (c) Donate them. Sponsor donates the cards to a card shop or community organization in the Colorado Springs area, chosen by Sponsor, for its free pile or similar community giveaway. Because the cards remain Sponsor's property until shipped (Section 12), the donation is made by Sponsor, and you may not claim any charitable deduction. (d) Destroy them. Sponsor destroys the cards (for example, by tearing them up, on or off stream) and discards them. This choice is irreversible.

9.5 How to tell us.

  • If you are present in Twitch chat when your Pack is opened, respond in chat when Sponsor or its bot prompts you by typing your choice: !mail, !pass, !donate, or !destroy. The bot only accepts the command from the recipient's own Twitch account.
  • If you are not present, Sponsor will contact you only through Discord — by direct message to your Discord account or, if your DMs are closed, by @mentioning you in the #the-cobblemon-initiative channel of Sponsor's Discord server (https://discord.gg/KvNqzn4m3h). Sponsor does not send notifications by Twitch Whisper, email, or any other channel. You must reply with your Decision within 48 hours of the time Sponsor sends the first notification, measured in Mountain Time — not from when you read it.
  • Be reachable. To receive anything, you must be a member of Sponsor's Discord server, allow direct messages from server members, and make sure Sponsor can match your Twitch account to your Discord account: connect your Twitch account to your Discord profile (Discord Settings → Connections) and display it, use the same username on both, or post your Twitch username in the #the-cobblemon-initiative channel. If Sponsor cannot identify a Discord account for you within 7 days after your Pack is opened, your cards are forfeited under Section 12. Sponsor is not responsible for notifications that are blocked, unread, or missed.
  • A Decision is final once made. If you do not respond within 48 hours, or your response is unclear and you do not clarify it within the 48-hour window, your cards are forfeited under Section 12.

10. Redemption for Mailed Cards

If you choose "Mail them to me":

  1. Sponsor will send you a unique single-use coupon code by Discord direct message after your Decision. Codes go out in batches; Sponsor does not promise a specific sending date, and your 30-day redemption window does not start until the code is sent.
  2. Go to Sponsor's online store at https://store.thecompany.inc, add "The Initiative Pack" to your cart, and enter the coupon code at checkout. The code brings the item price and shipping to $0.00. Do not complete checkout if the total shows any amount other than $0.00 — contact Sponsor at contact@thecompany.inc instead. Sponsor will not reimburse any purchase made without correctly applying the code.
  3. Provide your legal name and a valid mailing address (street address or P.O. box) in the 48 contiguous United States or the District of Columbia. Freight forwarders and addresses outside that area are not accepted. If you are under 18, your parent or legal guardian must complete the order using their own name and address and must confirm their agreement to these Terms at checkout.
  4. Complete the order within 30 days of the time Sponsor sends the coupon code (Mountain Time). Codes expire automatically after 30 days.

Each coupon code is tied to one entrant, is non-transferable, has no cash value, may be used only once and only for the giveaway item, and is void if sold, shared, or used for any other product. The shipping name and address you enter must be your own (or your parent's or guardian's, if you are under 18). Sponsor will cancel any order that uses an address that has already received a Promotion shipment or that appears to violate Section 8.

11. Shipping

Sponsor pays standard shipping (carrier chosen by Sponsor) to the address you provide. Sponsor ships in batches as orders come in and does not promise a specific shipping or delivery date, but will make reasonable efforts to ship within a reasonable time after you complete your store order. Risk of loss passes to you when the package is handed to the carrier; Sponsor is not responsible for shipments that are lost, stolen, damaged, or delayed in transit, or that are undeliverable because of an incorrect or incomplete address, although Sponsor may, in its sole discretion, offer a one-time replacement from the Prize Pool. If a shipment is returned to Sponsor as undeliverable and you do not provide a corrected eligible address within 14 days of Sponsor's message, the cards are forfeited under Section 12.

12. Ownership, Forfeiture, and the Prize Pool

Cards remain Sponsor's property, held for your benefit, until they are handed to the carrier for shipment to you. Your cards are forfeited, without compensation, and returned to Sponsor's pool of giveaway cards (the "Prize Pool") if:

  • you do not communicate a Decision within the 48-hour window in Section 9.5;
  • Sponsor cannot identify a Discord account for you within the window in Section 9.5;
  • you choose mailing but do not complete your $0.00 store order within the 30-day window in Section 10;
  • your shipment is returned undeliverable and not corrected under Section 11;
  • you are found ineligible or are disqualified under Section 8; or
  • you choose "Pass them on" and no eligible Waitlist entrant accepts.

Sponsor may use Prize Pool cards for future giveaways, pass-alongs, donations, or any other purpose Sponsor chooses. Forfeited prizes will not be re-awarded to the forfeiting entrant, and a forfeiting entrant remains a Pack Recipient for purposes of Section 7.4.

13. Taxes

You are responsible for any federal, state, or local taxes on any prize you receive. If the total value of prizes you receive from Sponsor in a calendar year reaches the IRS reporting threshold (currently $600), Sponsor may require a completed IRS Form W-9 before shipment and may issue a Form 1099.

14. Publicity and Stream Content

By entering, you agree that Sponsor may use your Twitch username, Discord username, chat messages relating to the Promotion, and the recording of any drawing and of your Pack being opened (including any stated estimated value and your Decision) in live streams, VODs, clips, highlights, YouTube videos, social media, and other promotional materials, worldwide, without further notice, permission, or compensation, except where prohibited by law. Sponsor will not publicly display your legal name, email address, or mailing address.

15. Privacy Notice

Sponsor collects the following information to run the Promotion: your Twitch username and account details visible to Sponsor's bot (including follow status), YouTube channel name (for subscription verification), Discord username (if applicable), chat messages containing Promotion commands and Decisions, and — if you choose mailing — the legal name, shipping address, and any email address or other data collected by Sponsor's store platform at checkout (see the store's privacy policy at https://store.thecompany.inc/policies/privacy-policy). For entrants under 18, the name and address collected at checkout are the parent's or guardian's, and Sponsor may also collect the parent's or guardian's consent record.

Sponsor uses this information only to administer the Promotion, verify eligibility, conduct drawings, prevent fraud, ship prizes, comply with law, and as described in Section 14. Sponsor shares it only with service providers that help run the Promotion (such as its chat-bot provider, store platform, and shipping carrier) and does not sell it. Sponsor does not keep your email or shipping address. They exist only inside the store platform, only because checkout and shipping require them, and Sponsor will erase that personal data from the order within 30 days after your shipment is delivered (or after any undeliverable-return process in Section 11 ends), keeping only your Twitch and Discord usernames, your Decision, and the date your cards shipped. Sponsor does not add you to any mailing list or use your email for anything other than this shipment. To request access to, correction of, or deletion of your information, or to ask questions, email contact@thecompany.inc. Sponsor's privacy policy is at https://store.thecompany.inc/policies/privacy-policy. If you are a resident of a state with consumer privacy rights, you may exercise those rights through that email address.

16. Release and Limitation of Liability

By participating, you release and agree to hold harmless Sponsor, its affiliated companies, and their respective owners, officers, directors, employees, contractors, moderators, and agents (the "Released Parties") from any claim, loss, liability, damage, or expense of any kind arising out of your participation in the Promotion or your receipt, use, misuse, or inability to receive or use any prize, including claims relating to card condition, contents, or value; the conduct or outcome of any drawing; failed or delayed notifications; lost, late, damaged, or misdirected shipments; technical or platform failures; and any injury or property damage. If you are under 18, your parent or legal guardian agrees to this release on your behalf and on their own behalf. THE RELEASED PARTIES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. In no event will the Released Parties' total liability to any entrant exceed the ARV of one Pack. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

17. Platform and Trademark Disclaimers

This is a promotion by The Company, Inc. Twitch does not sponsor or endorse this promotion and is not responsible for it. The Promotion is not sponsored, endorsed, or administered by, or associated with, YouTube or Google LLC, and by participating you release YouTube and Google LLC from any and all liability related to the Promotion. Discord Inc. is likewise not a sponsor or administrator and is released from all liability. Pokémon, Pokémon character names, and the Pokémon Trading Card Game are trademarks of Nintendo, Creatures Inc., GAME FREAK inc., and/or The Pokémon Company; Sponsor is not affiliated with, sponsored by, or endorsed by any of them, and prizes are ordinary retail products purchased by Sponsor. All questions and comments about the Promotion must be directed to Sponsor, not to any platform or trademark owner.

18. General Conditions

Sponsor reserves the right to modify, suspend, or cancel the Promotion, in whole or in part, and to change the Promotion Period, if fraud, bot activity, technical failures (including chat-bot, Twitch, YouTube, Discord, or store outages), platform enforcement actions, product unavailability, or any other cause beyond Sponsor's reasonable control impairs the integrity or proper conduct of the Promotion, as determined by Sponsor in its sole discretion. If the chat-bot log is lost or compromised, Sponsor may determine entry order and drawing pools by other reasonable means (such as chat logs or VOD review), and may re-conduct a drawing whose integrity is in question. Sponsor may correct typographical or administrative errors. If any provision of these Terms is held invalid, the rest remain in effect. Sponsor's failure to enforce any provision is not a waiver. If these Terms conflict with any summary in chat, on stream, in a video, or on social media, these Terms control. The version of these Terms posted at the time you type !enter governs your entry.

19. Governing Law and Disputes

These Terms and the Promotion are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute arising out of the Promotion or these Terms will be brought exclusively in the state or federal courts located in El Paso County, Colorado, and you consent to their jurisdiction.

20. Winners List and Copy of Terms

For a list of Qualified Entrants and Drawing Winners (Twitch usernames), or a copy of these Terms, email contact@thecompany.inc with the subject line "Pack Giveaway," or write to Sponsor at the mailing address in Section 1, within 60 days after the Promotion Period ends. The list may also be shown on stream.
